The JOKER: mens rea program uniquely embodied the mission of the American Inns of Court by using innovative storytelling and legal analysis to inspire thoughtful reflection on how the justice system treats individuals with mental illness. Arthur Fleck, known to many as JOKER, struggled to exist --- both in the outside world and within the confines of the criminal justice system. This struggle—and the surreal journey Arthur undertakes after crossing paths with Harley Quinn—was brought to life through this presentation. The program covered a serious and important topic- THE INTERSECTION OF MENTAL ILLNESS AND CRIMINAL COURTS. In addition to delivering educational content through the lens of Arthur’s darkly compelling story, the program was presented in a unique and unprecedented manner – in an actual film (yes- like a ‘movie’ film) that was played at an actual rented out movie theater! The educational content covered a wide legal spectrum- from United States Supreme Court precedent on whether individuals can be executed despite severe mental illness, to California law on the right to self-representation of defendants who may lack mental competency, and included the procedural framework for determining competency to stand trial, statutory mental health diversion rights to those with qualifying diagnoses, and real-world examples of how the system is evolving to support mentally ill individuals through treatment and supervision, rather than defaulting to punitive measures such as convictions or incarceration.
