Unfriendly Skies: The Trial Lawyer and the Untriable Case
This is the story of a program that set out to demonstrate one proposition and that ended up, through the collective wisdom of engaged members, demonstrated the opposite. This program presents to members the fact pattern of a seated airline passenger who once seated refuses to give up his seat for a traveling airline employee. Through a series of segments presenters engaged members in an analysis of whether the case triable for civil litigation. Segment One addressed the steps to be taken before a complaint is filed. Segment Two addressed what should an ethical attorney need to consider when deciding what may be done with information from discovery. Segment Three of demonstrated the mediation of the dispute as presented before the court. The Fourth segment of this program addressed jury selection and the untriable case. At the conclusion of the program members were asked once again to cast their vote to determine whether the issue was triable based on the new information they had learned.
