TRUTH - Is it Slip Sliding Away . . . And What Should We Do About It?
In this era of fake news and alternative facts we are living through a crisis of the "truth." This epistemological turmoil has far reaching consequences, especially for the field of law and the justice system. Within the context of a contentious school board hearing that leads to a family law proceeding and custody battle, Act I addressed the following issues: What is the goal of our justice system? Is it to find the truth? What role does the judge and the attorney play in the pursuit of the truth? Act II continued the family law scenario with an evidentiary hearing, and then a referral to the District Attorney for prosecution of perjury and forgery. Presenters addressed whether it’s really possible to determine credibility and truth, and what obstacles may stand in the way. Also addressed was the prosecutor’s special duty to ascertain the truth and what difficulties arise in the pursuit thereof. The moderation ended with a discussion of whether our current crisis is really about a loss of “truth,” or rather a loss of “trust,” and brought this idea home by soliciting ideas from the participants on how to restore the trust in our legal system.
